Thank you to the Freedom Angels for all their help and support. We couldn't have done this without you.
No one has to give pro bono time. One does so because it is the right thing to do, when as here, something was patently wrong in Ken Marsh's prosecution and conviction for Phillip's death. We would like to thank the following for their generous pro bono time.
Gregory Reiber, M.D., California. Dr. Reiber is a forensic pathologist who provided numerous pro bono hours in forensic autopsy review. Dr. Reiber has been a member on child death review teams, has researched and published short fall articles. He was instrumental in examining Phillip's autopsy findings and identifying resuscitation and secondary findings. Dr. Reiber is a nationally recognized forensic pathologist who teaches at the U.C. Davis, California.
Thomas Schweller, M.D., California. Dr. Schweller is board certified in neurology and pediatrics. Dr. Schweller took time from his busy clinical practice to provide medical record review and expert assistance pro bono.
Janice Ophoven, M.D., Minnesota. Dr. Ophoven has been a board certified forensic pathologist since 1981. Her clinical practice is pediatric forensic pathology. Dr. Ophoven generously provided a complete review of the case and a second opinion of Dr. Reiber's autopsy review concurring with his evaluation of Phillip's autopsy, medical records and Phillip's cause of death.
Michael Innis, M.D., Australia. Dr. Innis has over 30 years experience in pathology and hematology. He generously donated his time to review Phillip's clinical records and autopsy report and provided his declarations to the court.
John Plunkett, M.D., Minnesota. Dr. Plunkett is a forensic pathologist and a nationally recognized expert in childhood head injury, who has published studies and articles on short falls. Dr. Plunkett evaluated and consulted on the case pro bono giving generously of his time with detailed explanation of scientific principles.
Kirk Thibault, Phd, Biomechanics, Inc., Philadelphia. Dr. Thibault is a biomechanical engineering expert who has studied and taught the mechanics of bodily injury and the mechanics of pediatric brain injury. Dr. Thibault was instrumental in analyzing the kinematics of Phillip's fall and the medical literature that contains anecdotal studies. Although Dr. Thibault was retained at indigent rates, his time to completely review the case exceed the court approved hours. Rather, than limit his evaluation, Dr. Thibault did an extremely detailed evaluation and generously gave his time pro bono.
Michael Newman, Tactical Investigations, San Diego, California. Michael provided pro bono assistance with witnessed interviews of critical witnesses. He has the ability to take very extensive notes and provided detailed reports helpful to preparing declarations in support of Marsh's successive habeas petition.
Charles Sevilla, Esq., San Diego, California. Attorney Sevilla generously gave of his advice as a second set of eyes on the procedural pitfalls of a successive habeas petition.
Toni Blake, J.D., Shaken Baby Defense.com. - Although Phillip's head injury resulted from an accidental short fall, much of the same testimony used to prosecute and convict Ken Marsh is the same testimony often given in shaken-baby cases. Toni is a great resource for medical literature on pediatric head injury as she has made shaken-baby her speciality.
Roberta Thyfault, Esq., is a professor at California Western School of Law. She assisted when the hospital forced Brenda to retain an attorney to review the medical records of her deceased son. Roberta also assisted with a public records act request to the Medical Examiner's Office in 2002.
