Petition for the release of Ken Marsh, An Innocent Man.
Ken Marsh was convicted of murdering my two-year old son Phillip Buell in 1984. The physicians at Children's Hospital San Diego accused Ken Marsh of murder to protect themselves from a potential malpractice lawsuit.
Phillip fell from the top of my sofa and hit his head on the brick hearth of our fireplace the day Ken Marsh was baby sitting my son and daughter. Ken Marsh called the paramedics immediately and when the paramedics arrived they found no other injuries on Phillip's body except for the injury to his head. Phillip was taken to Children's Hospital for emergency treatment.
My son Phillip had a blood clotting weakness that caused abnormal bleeding and bruising at the slightest touch. At Children's Hospital he was subjected to intensive medical intervention that caused severe bruising to his little body. The resident physician at Children's Hospital also injected Phillip with Mannitol, a blood-thinning drug that caused his brain to massively swell. Within 40 minutes of this injection, his heartbeat slowed and his blood pressure dropped. A neurologist did not see him for nearly three hours that day. My son subsequently died. The rest of this tragedy continued to ruin more lives when:
1) Children's Hospital performs the only autopsy - an obvious conflict of interest.
2) The Children's Hospital physician destroys physical evidence by discarding ALL blood and tissue samples, without even testing them.
3) The Children's Hospital physician omits from a delayed death certificate the prior notation at the time of death of poisoning by other medicines.
4) The Children's Hospital physician testifies as an expert forensic witness and misleads the court and jury by overstating his qualifications.
5) To further fool a jury, Children's Hospital presents shocking photos of injuries, actually caused by medical treatments and equipment, as evidence of a beating.
6) Ken Marsh had only the bare legal minimum defense. The attorney, his first case of this type, offers no expert testimony.
Because of my belief in Ken Marsh's innocence, the District Attorney's office unsuccessfully tried to have my surviving daughter taken from our family and put into foster care. Since Ken Marsh was convicted, five other people falsely accused in similar cases by the same incompetent Children's Hospital physicians have been exonerated.
The Supervising Homicide Detective assigned to this case declared Phillip's death an accident and Ken Marsh innocent. The Director of Autopsy at UC Davis Medical School has reviewed the case and found that Phillip's death was caused by the an accidental fall exacerbated by the Mannitol injection given to him at Children's Hospital. Additional forensic specialists and legal experts have studied this case without compensation and agree Ken Marsh is innocent.
